On the morning of November 28, 2019, Chongqing Liangjiang New Area (Free Trade Area) People's Court invited Dr. Xiao Jingyi, president of Lan Hai Institute and Executive President of Council of BCI & BIMC, to give a lecture on Prevention of and Response to Legal Risks in the "Belt and Road". Representatives from High Court of Chongqing, No.1 Intermediate People's Court of Chongqing Municipality, Lawyers Association of Chongqing, and enterprises in the Free Trade Area, and mediators invited by Chongqing Liangjiang New Area (Free Trade Area) People's Court, together with 200 police officers of Liangjiang New Area, attended this seminar.
During the seminar, keynote speaker Dr. Xiao Jingyi anchored on topic "Belt and Road" law ascertainment and risk prevention—from the perspective of law ascertainment and commercial mediation, and explained to participants some frequently asked questions such as why conducting Foreign Law Ascertainment, what, where, and how to conduct it. Dr. Xiao also enumerated the legal risks that may arise due to immensely different legal cultures in countries of different legal systems along the corridor in the Belt and Road development, or legal risks caused by complexities in legal regimes of those countries, and the ways to cope with them. Furthermore, Dr. Xiao Jingyi gave detailed explanation on the main content of the Singapore Mediation Convention, its impact on China and challenges face by Chinese courts after China signed the Convention, in the context of "the Belt and Road" initiative. She offered a guidance for the participants to comprehensively consider factors of fore-related disputes in foreign law ascertainment, such as the subject, object, content, legal facts of legal relations, fully respect the parties' autonomy to choose applicable laws, actively ascertain and accurately apply foreign laws, and help eliminate legal concerns of parties from countries along the corridor in their business relations. The lecture was both profound and easy to understand, which provided sufficient knowledge for the present legal professionals to enhance their expertise, and offered both theoretical and practical legal guidance for Liangjiang New Area (Free Trade Area) People's Court in the development of the Yangtze River Economic Belt, "New Land and Marine Routes" and the "Belt and Road Initiative".
Then, Ms. Han Ting, BCI & BIMC's Council Member, introduced BCI & BIMC's innovated legal services to participants, including its platform operation, its foreign law ascertainment with relevant ascertainment cases, and the construction of its legal databases. Ms. Han demonstrated the operation of BCI & BIMC's foreign law ascertainment system on site.
Before the lecture, Mr. Qiu Xiaoyin, the Secretary of the Leading Party Members' Group and Chief Judge of Liangjiang New Area (Free Trade Area) People's Court, met with Dr. Xiao Jingyi, BCI &BIMC's Executive President of Council. Mr. Qiu expressed his sincere appreciation to Dr. Xiao on behalf of Liangjiang New Area (Free Trade Area) People's Court.
